In the event we fail to comply with all conditions of this letter, we understand that a civil lawsuit may be filed against us with the New Jersey Superior Court under the provisions of N.J.S.A. 2A:58-1 et seq., the Penalty Enforcement Law. Under the terms of said law, we may be subject to fines for each and every day during which said violation continues, each day constituting an additional, separate and distinct offense.
